Erika Jayne revealed she’s ready for even more change after estranged husband Tom Girardi’s prison sentencing and their divorce gaining more steam.

“I have a lot legally going on, and it’s all, like, storming at one,” Erika, 54, told Teddi Mellencamp on the Friday, July 11, episode of their “Diamonds in the Rough” podcast. “I have a lot. Yes, and one of them is the divorce.”

Erika explained that her and Tom’s divorce, which began when she filed in November 2020, “should be happening here” any time after four years of delays.

“I mean, it’s in motion. It’s always been in motion,” Erika said. “But now that Tom is, you know, sentenced to prison, yeah, it’s time to get a divorce and all that s***.”

The singer teased, “It’s just time to shed all of that and move on [and] make the next chapter of my life as best as it can be.”

Erika has been trying to move forward for nearly five years after announcing her split from Tom, 86, in 2020. The pair were married 21 years before they parted ways, and their issues only grew worse after their separation.

In December 2020, Tom was accused of embezzling settlement funds that were meant for victims of families killed in a plane crash.

Erika was then accused alongside her estranged husband of embezzling the money to fund their lavish lifestyles. The Real Housewives of Beverly Hills star maintained that she didn’t know about Tom’s wrongdoings, and in January 2022, the complaints of fraud and embezzling against Erika were dismissed.

Tom, meanwhile, was disbarred by the State of California that same year. He was indicted on five counts of wire fraud in February 2023. Tom pleaded not guilty.

Us Weekly confirmed in August 2024 that Tom was found guilty on four counts of fraud after embezzling more than $15 million from multiple law firm clients.

Last month, Tom was sentenced to seven years and three months in prison. The disgraced lawyer was also ordered to pay more than $2 million in restitution.

Erika learned of the news while in London for a series of performances. “And then 10 minutes before the second show, I get the news that Tom is being sent to prison. … It just hurts,” she confessed during the June 13 episode of her and Mellencamp’s podcast. “It reopens old healing wounds, and it is something that, you know, I had a sold-out crowd in a theater just for me, and I was so grateful. My happiest place in the whole world to be is on stage. So while I was happy … there’s a little piece [of me] that was like, ‘Ugh.’”

With Tom behind bars, his and Erika’s divorce is now being reevaluated and could be thrown out. After Erika’s lawyer was present for a June 26 hearing for the case and a representative for Tom was not, a judge set a hearing for August 1, according to court documents obtained by Us.

During the upcoming hearing, Tom and Erika must explain why no judgment has been entered in their case.
